General Terms & Conditions for German courses and Examinations at the German Language Academy – Deutsche Sprachenakademie

1. Registration for the German course / exam
a) Registration for the German course

With the signature on the form “Registration for the German course” (self-payer) or “Registration form for the privacy policy” (for subsidized participants) a binding registration takes place. By signing up, the General Terms and Conditions of the German Language Academy are recognized. The binding registration obliges the participant to pay the course fee in the amount specified in the registration form. Payment must be made within 14 days of registration. If the course fee has been agreed on a module-by-module basis, the participant agrees to timely payment in accordance with the corresponding payment plan. For courses with more than 400 (fourhundred) lessons, in case of payment of the complete course fee, the participant will receive 10 (ten) percent discount on the total price at least 7 days before the beginning of the course. For missed lessons as well as on the non-commencement of the course already paid amounts are not refunded. The course fees are generally exempt from value added tax in accordance with § 4 no. 21a bb UStG. The start and finish dates as well as the location of the German course will be communicated to the participants in writing unless they have been named on the registration form. Participants in the integration course supported by the BAMF will be given the “Information sheet on the integration course” when they register. The instructions and stipulations listed here are part of the General Terms and Conditions of the German Language Academy. However, it is expressly pointed out that with high registration numbers, the waiting time for an integration course after the date of registration can currently amount to significantly more than six weeks. The German Language Academy has the right, in this case, also to refer to another authorized executing carrier of the courses. Participants in B2 / C1 courses receive with the registration the “leaflet for participants in the B2 / C1 courses”. The instructions and stipulations listed here are also part of the General Terms and Conditions of the German Language Academy. Participants whose tuition fees can be paid by the responsible Job Center must provide a “request for funding from the placement budget” or a notice from the Job Center to cover the costs.

b) Registration for the exam
With the signature on the form “Registration for examination” a binding registration takes place. The examination fee must be paid in cash or by debit card when registering for the exam directly at the German Language Academy. The date and place of the examination will be communicated to the participants in writing, as far as they are not yet named on the registration form. By signing up, the General Terms and Conditions of the German Language Academy are recognized.

2. Resignation from the registration for the German course / examination
a) Resignation from the registration for the German course

Participants may cancel the registration for the German course by written statement to the German Language Academy (also by fax or e-mail) within 14 days. Decisive is the date of receipt of the declaration of withdrawal at the academy. Only then are course fees waived or already paid course fees refunded. In case of withdrawal from the registration after expiry of the 14-day period, a processing fee of € 30 ,– (thirty euros) will be charged. It will be retained upon reimbursement of any paid course fees. A refund is only by bank transfer. Discounts granted will be deducted on repayment. After the beginning of the course, the course can be terminated with a 14-day notice period at the end of each module by a written statement to the German Language Academy (also by fax or e-mail). Decisive is the date of receipt of the declaration of withdrawal at the academy. A reimbursement of the course fee paid for the module is not possible. Course fees paid beyond the end of the module will be refunded by the German Language Academy in the case of acceptance of the termination. The German Language Academy is entitled to withdraw from the course if the course can not be completed due to insufficient numbers of participants or if it can no longer be continued economically or if it has to be canceled due to a lecturer’s illness. The German Language Academy informs the participants about this in good time. Already paid fees for attributable hours will be refunded in this case. In addition, the German Language Academy may terminate the contract without notice for good cause. Such a reason exists in particular if the participant intentionally or grossly negligently violates the obligations under Section 4 and continues this action even after a written warning by the German Language Academy. An important reason also applies if the participant culpably disturbs the course of the lesson massively or harasses or threatens other participants or employees or freelancers of the German Language Academy. An important reason also exists if the participant has fallen behind with the payment of course fees. In case of extraordinary termination by the German Language Academy, the participant has to pay the course fee until the end of the module.

b) Resignation from the registration to the exam

By the deadline for registration (noted on the registration form), participants may withdraw from the application for the exam by written or personal explanation on the spot. Already paid fees will be refunded. Decisive is the date of receipt of the declaration of withdrawal at the academy. In case of the participant’s withdrawl from the registration for the exam after the registration deadline, a default fee of € 20,– (twenty euros) will be charged. The rest of the already paid fee will be refunded. If registered candidates for the examination day provide a certificate of disability or a medical certificate, no penalty will be charged.

3. Duties of the Academy

The Academy is committed to the proper professional and educational implementation of the German course and to the proper conduct of the exam. The contents of the German course are based on the Common European Framework of Reference for Languages (GER). The Academy reserves the right to change lecturers, relocate or change the program schedule or exceed the maximum number of participants, provided this does not fundamentally change the purpose of the event. Participants are not entitled to a specific lecturer or venue. The German Language Academy reserves the right to change or postpone the intended sequence of individual course hours in the case of a short-term illness of a lecturer. In this case, the participants will be notified immediately.

4. Duties of the participants

Participants of the German course commit themselves to support the measure success in the learning behavior by active participation. The regular and punctual course attendance is obligatory. The rules and regulations of the house rules that are customary for educational events are recognized. Religious, ideological, party political or commercial advertising is not permitted in the premises of the German Language Academy. The information on the use of the technical equipment valid at the venue must be observed. The instructions of the management of the German Language Academy and their representatives to maintain proper operation of the event are to be obeyed.

5. Termination of the German course

a) The Academy can terminate participants for good cause without notice and refuse further course participation. An important reason exists in particular if:

  • the participant does not comply with the obligation to pay,
  • repeated or serious violations of the house rules,
  • obvious learning refusal is detected.

b) The Academy may also terminate the participant with a notice period of 14 days to the end of a German course section, if there is a legitimate interest of the Academy. A legitimate interest of the Academy in terminating the contract exists in particular if a prolonged or repeated absence jeopardizes the success of the trainee or if his learning disability is pedagogically determined.

c) The participant may terminate the application in writing (including by fax or e-mail) within 14 days of the end of a course period if there is a legitimate interest in terminating the course agreement. A claim for reimbursement of already paid course fees for the current module does not exist in this case.

6. Exclusion of liability

a) Claims for compensation of participants are excluded unless otherwise stated below. The above exclusion of liability also applies to the benefit of the legal representatives and vicarious agents of the Academy, if the participant asserts claims against them.

b) Excluded from the exclusion of liability under a) is the liability for damages resulting from injury to life, limb or health, which are based on a negligent breach of duty by the Academy or a willful or negligent breach of duty by a legal representative or vicarious agent of the Academy. Also excluded from the disclaimer is the liability for other damages that are based on an intentional or grossly negligent breach of duty by the Academy, its legal representatives or vicarious agents. The German Language Academy is not liable for the loss or theft of goods, valuables or the clothes of the participant.

7. Privacy Policy

a) Personal data, which are needed to carry out the language course, are processed and stored in compliance with the provisions of the Federal Data Protection Act (BDSG) by means of EDP. The collection, storage and use of the personal data of the participants takes place exclusively in the context of the event organization and for billing purposes.

b) The storage and use of personal data in order to send information material to the participant and to adapt the course offer of the Academy to his / her needs will only take place if he / she has expressly given his / her consent in the following. The participant has a right of withdrawal at any time with regard to a given consent.

c) The participant is informed and agrees that personal data will be passed on for communication with the Youth Migration Service or the Migration Advisory Service. The participant can revoke this consent at any time in writing (also by fax, e-mail or in person for the record).

d) In addition, personal data are neither accessible to third parties nor are they passed on to third parties in any form. Only the obligation arising from the law or a court judgment may lead to the disclosure of personal data.

8. Default charges

For every out-of-court postal reminder to the participant, an amount of € 4.00 (four euros) may be charged after payment default (in accordance with § 286 ff. BGB) to cover postage and administration costs. The collection of default interest and the assertion of other damages due to delay remain reserved.

9. Additional and ancillary agreements

Additions or changes to this agreement must be made in writing.

10. Place of Jurisdiction

Exclusive place of jurisdiction is Münster.
